USER RESPONSIBILITY AND REGISTRATION OBLIGATIONS

In case it is found that you are in violation of these express conditions, you shall be solely responsible and shall face all legal consequences of the same by yourself, and SargAbandh of harmony shall in no manner be held responsible for the same.

AVAILABILITY OF GOODS AND ORDER CONFIRMATION

SargAbandh of harmony is committed to ensuring a seamless shopping experience. Once your order has been successfully placed and payment has been completed, we shall endeavor to fulfill it in a timely manner.

In the event that a product/s becomes unavailable after your order has been confirmed and paid for, we shall promptly initiate a refund for the amount paid for the unavailable product. If your order includes product/s that are temporarily unavailable, we shall expedite the shipment of the available product/s at the earliest, ensuring that you receive them without delay. The remaining product/s shall be dispatched with priority status immediately upon restocking.

All orders are subject to acceptance by us and availability of the requested item(s). After placing an order, you will receive an email from us acknowledging that we have received your order. The email will state the item(s) you have ordered, the cost (including GST where applicable and postage and packaging) and delivery and invoice details. If your order has been unsuccessful, you will be made aware of the reason why and possible explanations. Please note that this acknowledgment email does not mean that your order has been accepted – your order constitutes an offer to us to purchase goods. All orders are subject to acceptance by us and we will confirm such acceptance by sending you an email confirming that we have dispatched the item(s) to you. That email shall represent our legal acceptance of the order you made to purchase the item(s).

BILLING

Prices displayed on the Website are inclusive of applicable GST (Goods and Services Tax) in accordance with Indian tax regulations. Delivery charges are additional and shall be calculated at checkout.

For international orders, GST shall not be applicable, and the final payable amount shall be adjusted accordingly at checkout. Any additional taxes, customs duties, or levies imposed by the destination country shall be your sole responsibility.

All credit/debit card transactions are subject to validation checks and authorization by the card issuer. If the issuer declines payment authorization, we shall not be liable for any resulting delay or non-fulfillment of the order.

PROMOTIONAL DISCOUNT CODES

At our sole discretion, we may, from time to time, offer promotional discount codes applicable to specific purchases made through our Website. The conditions governing such codes are as follows (unless stated otherwise):

  • a) Only one promotional code may be applied per order. A promotional code cannot be applied after an order has been placed.
  • b) Each promotional code is strictly limited to one-time use per customer.
  • c) Promotional codes are non-transferable and cannot be redeemed for cash.
  • d) The promotional code is intended for personal use only and must not be shared with or transferred to any third party.
  • e) We reserve the right to cancel or withdraw any promotional code at any time if we determine that its use violates its intended purpose or constitutes misuse, without prior notice or liability.
PAYMENT

By availing any of the payment method/s offered by us, we are not responsible or bear no liability of whatsoever nature in respect of any loss, damage or inconvenience arising directly or indirectly from or related to your transaction, including but not limited to the following:

  • (a) Lack of authorization for any transaction/s;
  • (b) Exceeding the transaction limit mutually agreed upon between you and your banking institution;
  • (c) Any technical or payment-related issues arising during the transaction process;
  • (d) Rejection, decline or failure of any transaction for any reason/s whatsoever.

All payments made against purchases on the Website shall be as against the MRP displayed on the Website and shall be subject to the terms and conditions of the third-party online payment gateway engaged by us. Before shipping your order, we reserve the right to request supporting documents (including but not limited to Govt. issued ID and address proof) to establish the ownership of the payment instrument utilized for the transaction.

We may, at our sole discretion, engage third-party service providers for payment processing, including but not limited to electronic payments and cash-on-delivery (COD) options, subject to availability and feasibility. The use of such third-party service providers shall be governed by their respective user agreements, Seller Terms and Conditions, and other Policies which shall apply in addition to the present Agreement.

We reserve the right to modify, limit, or discontinue any payment method at any time, without prior notice, at our sole discretion.

DELIVERY OF GOODS

SargAbandh of harmony endeavors but does not guarantee delivery of products in the stipulated time period as mentioned on the purchase of the product. In no manner can the contract be repudiated if SargABandh of harmony fails to deliver any one or more products in the stipulated time frame. However, if you fail to take the delivery of the goods, SargAbandh of harmony may, at its discretion, charge you for additional shipping costs.

Prior to order confirmation, the shipping address and pin code provided by you shall be subject to verification against our serviceable database. In the event that your location falls outside our delivery network, we shall request you to furnish an alternate shipping address. Any disputes arising from non-serviceable locations shall not render us liable for non-delivery.

Where multiple products are purchased in a single transaction, we will endeavor to ship all products together, however, this may not always be feasible due to logistical constraints. In such cases, shipments will be arranged as per availability without additional charges.

CANCELLATIONS

SargABandh of harmony strives to ensure a seamless and efficient order fulfillment process. However, due to unforeseen and unavoidable circumstances certain orders, despite being validly placed, may not be processed or dispatched. We reserve the right to refuse or cancel any order at our sole discretion and without prior notice. Circumstances that may warrant such cancellation include, but are not limited to:

  • Limitations on product availability, including stock shortages;
  • Errors or inaccuracies in product descriptions, pricing, promotional offers or other details on the Website;
  • Payment verification issues or concerns raised by our credit and fraud prevention department;
  • Quality concerns or product defects identified prior to dispatch;
  • Non-compliance with any of our terms and conditions or legal requirements;
  • Failure to provide additional verification or information upon request.

In the event of cancellation, we will notify you via email at the earliest possible opportunity. If the order is canceled after the payment has been processed, the amount will be refunded to the original payment source.

Any promotional vouchers, discount codes, or credits applied to the canceled order shall be reinstated and made available for future use, subject to the applicable terms and conditions.

CUSTOMER-INITIATED CANCELLATIONS

If you wish to cancel an order before dispatch, you must submit a formal request via email to customercareatsboh@gmail.com within and as per terms laid out for different order types on the website. Order cancellation requests shall be entertained solely at our discretion and subject to our prevailing terms & conditions at the time of the request.

REFUNDS & RETURNS

We are committed to delivering products of exceptional quality and damage free products to Buyers. Given the exclusive nature of our products, returns and exchanges are not permitted, except in cases where the product delivered is damaged during transit.

If you receive a product that falls within the above exceptions, you must notify us in writing at customercareatsboh@gmail.com within 24 hours of receipt. Any requests received beyond this timeframe shall not qualify for a return or exchange.

In cases where the product is eligible for replacement or return, the request must be made within 24 hours from the time of delivery. The item must be returned in its original condition, unused, and in its original packaging.

We reserve the right to inspect all returned products and determine, at our sole discretion, whether the products qualify for a replacement or refund. Please refer to the Return and Refund Policy.

INDEMNITY

You agree to indemnify and shall not hold SargAbandh of harmony (and its officers, directors, agents, subsidiaries, affiliates, joint ventures, and employees) liable for any claim or demand, including but not limited to reasonable attorneys’ fees, arising out of or related to your breach of this T&C, your violation of any law or the rights of a third party, or any damage to life and/or property caused by the products delivered.

BREACH

In the event you are found to be in breach of the Terms of Use or Privacy Policy or other rules and policies or if we are unable to verify or authenticate any information you provide or if it is believed that your actions may cause legal liability for you, other users or us, without limiting to the present, without prior notice immediately limit your activity, remove your information, temporarily/indefinitely suspend or terminate or block your membership, and/or refuse to provide you with access to this Website. Any User that has been suspended or blocked may not register or attempt to register with us or use the Website in any manner whatsoever until such time that such Buyer is reinstated by us.

Notwithstanding the foregoing, if you breach the Terms of Use or Privacy Policy or other rules and policies, we reserve the right to recover any amounts due and owing by you to us and to take strict legal action including but not limited to a referral to the appropriate police or other authorities for initiating criminal or other proceedings against you.

Any breach of any applicable local laws of that territory shall also result in, without prior notice immediately limit your activity, remove your information, temporarily/indefinitely suspend or terminate or block your membership, and/or refuse to provide you with access to this Website.

SEVERABILITY

We reserve the right to amend, modify or update the Website, its policies, the Agreement, and any other Terms and Conditions at our sole discretion. In the event that any provision of this Agreement is found to be invalid, void, or unenforceable under applicable law, such provision shall be deemed severable and shall not affect the validity, legality, or enforceability of the remaining provisions, which shall continue to remain in full force and effect.

WAIVER

No failure or delay on our part in exercising any right, power, or remedy under this Agreement shall operate as a waiver thereof, nor shall any single or partial exercise of any right, power, or remedy preclude any other or further exercise of the same or the exercise of any other right, power, or remedy.

A waiver of any provision of this Agreement shall be effective only if expressly stated in writing and duly executed by an authorized representative of the Sole Proprietorship . Any such waiver shall not be deemed a continuing waiver or a waiver of any other term or condition herein.

FORCE MAJEURE

We shall not be held liable for any failure or delay in the performance of its obligations, where such failure or delay arises from an event of Force Majeure. For the purposes of this Agreement, Force Majeure shall mean any event or circumstance beyond our reasonable control, including but not limited to war, civil unrest, riots, strikes, labor disputes, industrial actions, governmental orders or restrictions, embargoes, natural disasters, fires, floods, earthquakes, epidemics, pandemics, acts of terrorism, cyber-attacks, power failures, or any other cause that renders performance impracticable or impossible.

In the event that an obligation under this Agreement is delayed due to Force Majeure, the period of such delay shall be excluded from the computation of any deadlines prescribed herein. The affected party shall not be deemed in breach of its obligations for the duration of the Force Majeure event.

You expressly acknowledge and agree that lack of funds, financial distress, or economic hardship shall not, under any circumstances, constitute an event of Force Majeure.

GOVERNING LAW AND JURISDICTION

This Agreement shall be governed by and construed in accordance with the laws of India. In the event of any dispute, claim, or controversy arising between you and us in relation to your use of the Website, transactions conducted through the Website, or any activity involving us, including but not limited to the interpretation, validity, enforcement, or alleged breach of this Agreement and/or the Privacy Policy, such dispute shall be subject to the exclusive jurisdiction of the courts in Mumbai.

GRIEVANCE REDRESSAL

If you have any grievances, concerns, or complaints arising from your use of the Website, you may submit your concerns in writing to our Customer Care team via email at customercareatsboh@gmail.com

Upon receipt of your complaint/grievance, our Customer Care team shall undertake a thorough review and provide an appropriate response within customercareatsboh@gmail.com days from the date of receipt of the complaint.

All grievances shall be addressed in accordance with applicable laws, rules, and policies, ensuring a fair and transparent resolution process.
